My Personal Pantry — Terms of Service
Version: 1.2
Effective Date: October 5, 2026
Last Updated: October 5, 2026
These Terms of Service (“Terms”) govern use of the My Personal Pantry mobile application and related services (collectively, the “Service”). The Service is operated by Bellworth Logistics, LLC (“Bellworth,” “My Personal Pantry,” “we,” “us,” or “our”).
These Terms are written for the initial United States-only release. They should be read together with the My Personal Pantry Privacy Policy and Food Safety Disclaimer.
1. Purpose of My Personal Pantry
My Personal Pantry is a household organization and informational application designed to help adult users manage pantry inventory and related activities.
Depending on the features actually available in a released version, the Service may allow users to:
- create and manage pantry inventories;
- scan product barcodes;
- manually add or modify food and household items;
- track quantities and product-related dates;
- search pantry contents;
- discover and view recipes;
- compare recipe ingredients with pantry inventory;
- receive possible ingredient matches or substitutions;
- follow recipes using guided step-by-step cooking instructions;
- create grocery and general shopping lists;
- plan meals;
- synchronize supported Pantry information between supported devices;
- interact with third-party recipe, product, or other services; and
- use other features that are expressly made available in a released version.
The initial public release does not provide production AI processing. AI functionality is disabled and inaccessible to users in the initial release. Any future activation of AI functionality requires a separate product, provider, privacy, data-flow, configuration, and legal review before release.
No production user data is sent to an AI model provider for AI processing in the initial release.
Features may be added, modified, suspended, or removed as the Service develops. Descriptions of the Service must remain consistent with functionality actually available to users.
2. Eligibility
You must be 18 years of age or older to create or own a My Personal Pantry account or use account-connected features.
The initial release does not support child-owned accounts or a parental-consent account program.
By creating an account or affirmatively accepting these Terms, you represent that you are at least 18 years old and legally capable of entering into these Terms.
If the Service is later made available to users under 18, these Terms, the Privacy Policy, the account system, and applicable child-safety and privacy controls must be reviewed and updated before that access is enabled.
If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts
Certain features require a My Personal Pantry account.
When creating and maintaining an account, you agree to provide accurate and reasonably current information.
You are responsible for taking reasonable steps to protect your account credentials and devices. You should notify us promptly at support@mypersonalpantry.app if you believe your account has been accessed or used without authorization.
We may require authentication, reauthentication, verification, account-recovery steps, or other reasonable security measures when necessary to protect users, accounts, data, or the Service.
Account credentials, authentication tokens, and other authentication secrets must not be shared with others except through an authorized authentication process.
Account deletion is addressed in Section 28.
4. Multi-Device Synchronization
My Personal Pantry supports account-based synchronization for supported Pantry records.
For synchronized Pantry records, the Pantry data associated with the authenticated account is authoritative for account synchronization.
At the current stage of the Service, categories that may remain installation-local include:
- Meal Plan data;
- Grocery List data and checked state;
- manually added shopping items;
- imported recipe references or cards;
- recipe history;
- dietary preferences;
- appearance or theme preferences; and
- other local settings or user state.
My Personal Pantry does not invent or assume account ownership for installation-local data when that ownership cannot be safely established.
Synchronization is provided as a convenience and may be delayed or interrupted. Synchronized data may occasionally fail to synchronize, appear differently across devices, become duplicated or outdated, be incorrectly merged, or become temporarily unavailable because of connectivity, device, server, third-party, or other technical problems.
My Personal Pantry will not intentionally make silent Pantry mutations that bypass the user-facing behavior designed for Pantry changes.
Users should review important information and correct inaccuracies when appropriate. The Service should not be used as the only record for information where loss, delay, or inaccuracy could create a significant health, safety, financial, or other consequence.
If synchronization later expands to additional categories of data, the related product behavior, Privacy Policy, Terms, export behavior, and deletion behavior must be reviewed and updated as appropriate before or when that change takes effect.
5. Pantry Information and User-Entered Data
Users may enter, scan, edit, import, or otherwise provide information to the Service, including Pantry items, quantities, product names, package sizes, dates, shopping information, meal-planning information, preferences, feedback, and related information (“User Data”).
You retain the rights you have in your User Data. These Terms do not transfer ownership of your User Data to Bellworth Logistics, LLC.
You grant Bellworth Logistics, LLC a limited, non-exclusive right to host, store, process, display, transmit, synchronize, back up where applicable, and otherwise use User Data only as reasonably necessary to:
- provide features you request;
- maintain and secure the Service;
- synchronize supported data;
- troubleshoot technical problems;
- provide support;
- comply with law; and
- improve the Service in a manner consistent with the Privacy Policy.
This limited permission does not authorize the use of Pantry contents, recipe history, Grocery activity, Meal Planner activity, scan history, feedback, account behavior, or other personal app activity to build or influence a behavioral advertising profile.
The handling of personal information is governed by the Privacy Policy.
You are responsible for reviewing information you enter, import, scan, or approve for accuracy when accuracy matters.
6. Barcode Scanning and Product Identification
The Service may use one-dimensional or two-dimensional barcodes, product databases, manufacturer information, third-party data, or automated recognition components to identify products.
Barcode image recognition is intended to occur on the device. After a barcode is decoded, the resulting barcode value or product identifier may be sent to an external product-data service when needed to identify the product.
A successful barcode scan does not guarantee that the resulting product information is correct.
Product information may be incomplete, inaccurate, outdated, unavailable, incorrectly categorized, incorrectly named, or associated with a different product or package size.
Users should verify important product information using the original packaging, manufacturer information, or another reliable source.
7. Recipes and Ingredient Matching
My Personal Pantry may retrieve, display, organize, or link to recipes from external sources or other available data.
The Service may compare recipe ingredients against Pantry inventory and attempt to determine whether ingredients are available.
Ingredient matching may be inaccurate. For example, the Service may incorrectly determine that a branded product is equivalent to a generic ingredient, that an ingredient contained inside a packaged food exists separately in the Pantry, that similar foods are interchangeable, or that a sufficient quantity is available.
Users are responsible for reviewing recipe ingredients and deciding whether the ingredients they possess are actually suitable for a recipe.
Recipe functionality in the initial release does not use production AI processing.
8. Guided Recipe Instructions
My Personal Pantry may organize available recipe information into a guided, step-by-step cooking interface.
The Service may display ingredients, quantities, preparation instructions, temperatures, timers, notes, or other available recipe information.
This organization may use ordinary software processing and may contain errors, omissions, formatting problems, or incorrect interpretations. It does not imply that production AI processing is active.
Users should review the original recipe or source information when appropriate and use reasonable judgment while preparing food.
9. Ingredient Substitutions
The Service may display or suggest possible ingredient substitutions.
A substitution does not guarantee equivalent taste, texture, cooking behavior, nutritional characteristics, allergen content, suitability, or safety.
Users are responsible for deciding whether a substitution is appropriate for their circumstances and should independently verify safety-sensitive information.
10. Food Safety
My Personal Pantry is an organizational and informational tool. It cannot inspect food or determine its actual condition.
The Service cannot reliably determine whether food has spoiled, has been contaminated, was stored at an appropriate temperature, was handled correctly, has been recalled, has damaged packaging, contains an undeclared allergen, has been cooked sufficiently, or is otherwise safe to consume.
Users remain responsible for deciding whether food is appropriate to prepare, serve, or consume and should inspect food, follow appropriate food-handling practices, review manufacturer instructions, and use reliable safety information.
The separate My Personal Pantry Food Safety Disclaimer provides additional important information and must remain consistent with these Terms.
Nothing in this section waives a consumer right or Bellworth Logistics, LLC responsibility that cannot lawfully be waived.
11. Product Dates and Expiration Tracking
The Service may allow users to enter, scan, estimate, store, or track expiration, use-by, best-by, sell-by, purchase, or similar product dates.
These dates are organizational tools and may be incorrect, estimated, user-entered, outdated, or obtained from third-party information.
My Personal Pantry does not represent that food is safe merely because a displayed date has not passed, and it does not represent that food is necessarily unsafe merely because a displayed date has passed.
Users remain responsible for evaluating the condition and safety of food before use.
12. Allergies, Intolerances, and Dietary Restrictions
My Personal Pantry is not an allergen-detection or medical safety system.
Ingredient, allergen, dietary, substitution, recipe, and product information may be incomplete, inaccurate, outdated, or incorrectly interpreted.
Users with allergies, intolerances, sensitivities, dietary restrictions, or medical dietary requirements should independently verify relevant information using original packaging, manufacturer information, health professionals when appropriate, and other reliable sources.
Do not rely solely on My Personal Pantry to decide whether a food, ingredient, substitution, or recipe is safe for a person with a food allergy or medical dietary restriction.
Nothing in this section limits rights or remedies that cannot lawfully be limited.
13. Nutrition and Health Information
The Service may display nutritional information, calorie estimates, serving sizes, dietary classifications, ingredient information, or similar information.
That information may come from labels, recipe sources, third-party databases, calculations, or user input and may be inaccurate or incomplete.
My Personal Pantry does not provide medical advice, diagnosis, or treatment. Nutrition or health-related information displayed by the Service is for general informational and organizational purposes.
Users with medical conditions or specialized dietary needs should seek appropriate professional advice when necessary.
14. Shopping Lists and Non-Food Items
My Personal Pantry may allow users to create shopping lists containing food, household supplies, toiletries, cleaning products, pet supplies, or other items.
Shopping-list information is organizational in nature.
The appearance of an item in the Service does not by itself constitute a recommendation, endorsement, warranty, or representation that the product is appropriate for a particular person or purpose.
15. Retailer and Shopping Integrations
Retailer integrations are not part of the currently approved synchronized-data scope.
If a future version provides retailer links, searches, exports, purchasing integrations, or other retailer functionality, that functionality may be subject to additional terms and privacy disclosures.
My Personal Pantry does not control a third-party retailer’s prices, availability, substitutions, inventory, shipping, pickup, delivery, taxes, fees, transaction processing, product quality, or policies.
Unless expressly stated otherwise, purchases from a third-party retailer are transactions between the user and that retailer.
Shopping or product information should not be transmitted to a retailer unless the user invokes a feature that requires the transmission and the required disclosures and controls are in place.
16. Third-Party Content and Services
The Service relies on or may interact with third-party services. Current or planned-for-release providers may include, as applicable:
- Google / Firebase for authentication;
- Google technology for Android barcode recognition;
- Apple for Sign in with Apple when used;
- Render for backend hosting and database infrastructure;
- Spoonacular for recipe functionality;
- Open Food Facts for barcode and product lookup;
- Resend for email delivery; and
- Google AdMob for production advertising.
Third-party services may have their own terms, privacy policies, availability limits, and technical requirements.
Bellworth Logistics, LLC does not control third-party services and cannot guarantee their accuracy, security, availability, or continued operation.
Users must comply with applicable third-party terms when their use of a feature requires use of that third-party service.
No separate production analytics SDK is planned unless one is deliberately introduced, reviewed, and disclosed.
Production AI processing is disabled for the initial release.
17. Third-Party Recipe Content and Intellectual Property
Recipes, photographs, descriptions, trademarks, logos, and other materials obtained from third-party sources remain subject to the intellectual-property rights of their respective owners.
My Personal Pantry does not claim ownership of third-party content merely because the Service displays, organizes, references, or links to it.
Where appropriate, the Service may identify or link to an original content source.
Users may not use the Service to intentionally reproduce, distribute, publicly display, or commercially exploit third-party copyrighted material in violation of applicable law.
Imported third-party recipes are subject to product and privacy rules designed to avoid treating the full third-party recipe text as user-owned exportable content.
18. My Personal Pantry Intellectual Property and License
Except for User Data and third-party content, the Service and its software, designs, branding, interfaces, graphics, databases, documentation, trademarks, logos, and other materials are owned by or licensed to Bellworth Logistics, LLC and are protected by applicable law.
Subject to these Terms and applicable app-store rules, you receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for lawful personal or household purposes on supported devices you own or control.
No ownership interest in the Service is transferred to you.
Any restriction on reverse engineering, decompilation, interoperability work, security research, or similar conduct applies only to the extent the restriction is permitted by applicable law and applicable open-source license terms.
For Apple-distributed versions, the Apple-specific provisions in Section 26 also apply.
19. Acceptable Use
You agree to use My Personal Pantry only for lawful purposes.
You may not:
- interfere with or disrupt operation of the Service;
- attempt to gain unauthorized access to accounts, systems, or data;
- bypass security or access controls;
- introduce malware or harmful code;
- use automated systems to overload, scrape, or abuse the Service except where expressly authorized or protected by law;
- reverse engineer the Service except where the restriction is prohibited by law or permitted by applicable open-source licenses;
- impersonate another person or misrepresent authority to act for another person;
- use the Service for fraud or unlawful activity;
- interfere with another user's lawful use of the Service;
- manipulate advertising interactions or generate fraudulent or invalid ad traffic;
- misuse third-party integrations;
- violate intellectual-property or other legal rights; or
- use the Service in a manner that violates applicable law.
Nothing in these Terms prohibits or penalizes an honest consumer review, lawful complaint, report to a government agency, or other communication protected by the Consumer Review Fairness Act or other applicable law.
20. Availability and Changes to the Service
We may update, test, modify, suspend, discontinue, or replace features as the Service develops.
The Service may sometimes be unavailable because of maintenance, upgrades, connectivity problems, third-party outages, technical failures, cybersecurity events, or circumstances outside our reasonable control.
We do not guarantee uninterrupted or error-free availability.
Feature changes do not retroactively waive or eliminate consumer rights, accrued claims, or other rights that applicable law does not permit us to change unilaterally.
If a change materially affects legal terms, privacy practices, paid obligations, or another matter requiring affirmative agreement or notice, the applicable change process in these Terms, the Privacy Policy, or applicable law will control.
21. Beta, Early-Access, Experimental, and Future AI Features
A feature may be identified as beta, preview, experimental, or early access only when that status is made reasonably clear to users.
Such features may be incomplete, contain defects, behave unexpectedly, change substantially, lose data, or be discontinued.
Users should not rely on experimental features for safety-critical or other high-consequence decisions.
Production AI is disabled and inaccessible in the initial public release. Dormant AI engineering may exist in development repositories, but it is not a user-facing production feature.
Any future activation of AI functionality requires Product Owner approval and a new provider, privacy, data-flow, configuration, safety, app-store, and legal review before release. The Terms and Privacy Policy must be updated when required before users are exposed to that functionality.
22. Privacy
Our collection, use, storage, disclosure, retention, export, and deletion of personal information are described in the My Personal Pantry Privacy Policy.
The Privacy Policy is intended to match actual production behavior, including account information, synchronized Pantry data, installation-local data, advertising, service providers, retention, account deletion, Download My Data, and user privacy rights.
The current Privacy Policy is My Personal Pantry Privacy Policy v1.3.
The Privacy Policy and these Terms are separate legal documents and must remain factually consistent.
Privacy requests may be directed to privacy@mypersonalpantry.app.
23. Acceptance and Legal Documents
The My Personal Pantry Terms of Service, Privacy Policy, and Food Safety Disclaimer are separate legal documents.
Where required, users must affirmatively complete the legal-acceptance flow before account-connected functionality is available.
A user-facing acceptance distinguishes agreement to contractual terms from acknowledgment of disclosures and may state:
“I agree to the Terms of Service and acknowledge the Privacy Policy and My Personal Pantry Food Safety Disclaimer.”
Acceptance records may be associated with the authenticated account and may record the applicable document versions, app/build information, publication information, and server-recorded acceptance event or timestamp where applicable.
Current versions of the legal documents should remain reasonably accessible from the Service and from stable public references where required.
If renewed legal acceptance is required, the main application may remain locked until acceptance. During that lock, a restricted Account & Privacy surface may remain available for:
- legal acceptance;
- Download My Data;
- Delete account;
- Contact privacy support; and
- Sign out.
We do not rely solely on continued use of the Service as acceptance of materially changed Terms.
24. Advertising
My Personal Pantry plans to use Google AdMob for advertising in the initial production release.
Advertising is intended for signed-in adult users only.
The advertising model is intended to be contextual / non-behavioral. Pantry contents, recipe history, Grocery activity, Meal Planner activity, scan history, feedback, account behavior, dietary information, and other personal app activity must not be used to build or influence a behavioral advertising profile.
AdMob category and blocking controls may be used to bias or restrict advertising toward food, grocery, cooking, kitchen, household-food brands, and related categories where practical. We do not promise that every advertisement will be food-related.
Advertisements and linked offers are provided by third parties and do not constitute Bellworth Logistics, LLC's endorsement of the advertised product or service.
Ads must be distinguishable from app content and must not be implemented in a deceptive or manipulative manner.
The released application must provide any ad-reporting, dismissal, transparency, consent, privacy-options, or withdrawal controls required by applicable law and the applicable app-store policies. If an iOS release contains ads, it must provide a way for users to report inappropriate or age-inappropriate ads.
The Privacy Policy describes advertising-related data processing and privacy choices.
Final production AdMob, UMP, privacy-options, ad-reporting, and Data Safety behavior remains later release-readiness work and must be completed before advertising is enabled for the application's public release.
25. Fees, Purchases, and Subscriptions
If paid functionality is introduced, the applicable terms and purchase flow must clearly disclose, before the user agrees to pay:
- the total price or charge;
- what the user receives;
- the billing period and frequency, if recurring;
- whether and how the charge automatically renews;
- the length of any free trial;
- the amount charged after a trial;
- how to cancel;
- when cancellation takes effect;
- any refund rules;
- any taxes or other mandatory charges; and
- the applicable Apple App Store or Google Play billing rules.
Recurring billing may not use deceptive enrollment, hidden terms, obstructive cancellation, or abusive retention tactics.
Before any recurring paid offering is released, it must be reviewed against the then-current requirements of Apple, Google Play, federal law, and applicable state automatic-renewal laws, including stricter state requirements governing clear disclosures, affirmative consent, retainable confirmations, simple cancellation, and material-change notices.
26. Apple App Store, Google Play, and Other App Marketplaces
Use of a version of My Personal Pantry obtained through an app marketplace is also subject to applicable marketplace terms and usage rules.
Apple App Store
If My Personal Pantry is distributed through the Apple App Store, Apple's then-current Standard Licensed Application End User License Agreement applies to the iOS application license as required by Apple unless Bellworth Logistics, LLC separately provides a valid custom end-user license agreement through Apple.
For Apple-distributed versions:
- these Terms are between you and Bellworth Logistics, LLC, not Apple;
- Bellworth Logistics, LLC, not Apple, is responsible for the Service and its content, subject to applicable law;
- Apple has no obligation to provide maintenance or support for My Personal Pantry except as required by applicable law or Apple's own terms;
- Bellworth Logistics, LLC is responsible for addressing claims relating to My Personal Pantry, including product, consumer-protection, privacy, and legal-compliance claims, to the extent required by law;
- Bellworth Logistics, LLC is responsible for handling third-party intellectual-property claims relating to My Personal Pantry to the extent required by applicable law;
- you must comply with applicable third-party terms when using the Service;
- Apple and its subsidiaries are intended third-party beneficiaries of the Apple-specific terms and may enforce those terms as permitted by Apple's requirements; and
- use and export of the application must comply with applicable United States export-control and sanctions laws.
Google Play
A version distributed through Google Play is also subject to applicable Google Play terms, policies, billing rules, refund rules, content requirements, advertising requirements, and account-deletion requirements.
Google is not responsible for obligations undertaken solely by Bellworth Logistics, LLC except where Google Play terms, policy, or applicable law provide otherwise.
27. Account Suspension and Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate access when reasonably necessary because of:
- a material violation of these Terms;
- unlawful activity;
- fraud or attempted fraud;
- a material security threat;
- abusive use;
- misuse of third-party services;
- invalid or fraudulent advertising activity;
- conduct that materially threatens the Service or other users; or
- another lawful reason reasonably related to operation or protection of the Service.
Where practical and legally appropriate, we may provide notice before a suspension or termination. Immediate action may be taken when reasonably necessary to address security, fraud, legal, or technical risks.
We will not suspend or terminate an account merely because a user exercises a lawful privacy right, consumer right, or right to post an honest review.
Termination does not eliminate rights or obligations that arose before termination, and provisions that by their nature should survive termination may continue to apply.
28. Account and Data Deletion
My Personal Pantry provides an account-deletion process.
Deletion is intended to cover, as applicable:
- the My Personal Pantry account;
- Firebase authentication identity or sessions;
- synchronized Pantry information stored by My Personal Pantry;
- processor-held account data where deletion is supported or required;
- local account-associated application data where applicable; and
- operational remnants that must expire under the documented retention rules.
The existing in-app deletion experience is the approved product direction. No additional grace period or additional confirmation step has been approved.
Google Play requires an account-deletion path both inside the app and through an external web resource for apps that permit account creation.
When Sign in with Apple is linked, the in-app deletion flow obtains fresh Apple authorization and requests revocation of the Apple token before backend deletion proceeds. Deleting the Firebase user alone does not establish that Apple authorization was revoked. The external web deletion path cannot obtain that fresh Apple token and instead provides guidance for manually disconnecting My Personal Pantry through Apple Account controls.
Disconnecting My Personal Pantry through Google Account controls stops ongoing Google provider access but does not retract information already received by Firebase or Bellworth Logistics, LLC and does not itself delete My Personal Pantry data. These Terms do not assign a fixed provider-side residual-retention period to Google or Apple.
Live account data should be removed as soon as reasonably possible after deletion. Where immediate removal from backups or operational systems is technically impossible, retained remnants must be limited to the documented retention periods and legitimate legal, security, fraud-prevention, or backup-expiration purposes described in the Privacy Policy.
Ordinary Bellworth-controlled deleted-account operational remnants are limited to a maximum of 30 days where immediate deletion is technically impossible, subject to legitimate legal, security, fraud, abuse, or preservation exceptions. Minimized Pantry tombstones, deleted-account suppression and fence records, and mutation or idempotency records may persist where necessary to prevent resurrection, replay, duplicate processing, or synchronization corruption. Those records are not substitutes for active user content and are minimized and limited to safety and integrity purposes; no 30-day maximum is imposed on those approved safety mechanisms.
Some installation-local information may not be account-owned. The Service must not falsely represent installation-local data as account data when ownership has not been safely established.
Account deletion may permanently remove synchronized data and other account-associated information. Android provides an implemented Download My Data feature for eligible account-owned information. It does not represent installation-local Meal Plan, Grocery List, imported recipe, preference, or similar data as account-owned when ownership cannot safely be established. No iOS export implementation is claimed. Users who want a copy of eligible information should use Download My Data before deletion when practical, but deletion must not be conditioned on completing an export.
Privacy-email assistance remains available at privacy@mypersonalpantry.app.
29. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
Bellworth Logistics, LLC does not promise that the Service will always be uninterrupted, error-free, completely secure, or completely accurate.
Because My Personal Pantry relies on user-entered data and third-party information, we do not warrant the accuracy or completeness of Pantry information, product data, barcode information, recipes, ingredient matching, substitutions, shopping information, nutrition data, date information, advertising content, or third-party content.
These disclaimers do not exclude or limit any warranty, statutory protection, remedy, or responsibility that applicable law does not permit us to exclude or limit.
For New Jersey consumers, this section is not intended to waive any clearly established consumer right or Bellworth Logistics, LLC responsibility under New Jersey or federal law.
30. Limitation of Liability
To the maximum extent permitted by applicable law, Bellworth Logistics, LLC and its owners, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Service when such damages may lawfully be excluded.
This may include, subject to applicable law, indirect or consequential loss arising from inaccurate Pantry data, product-date errors, recipe errors, ingredient-matching errors, barcode-identification errors, nutrition information, third-party content, retailer services, failed synchronization, data loss, or service interruptions.
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- willful misconduct;
- gross negligence or greater-than-ordinary negligence where liability cannot lawfully be limited;
- death or personal injury where applicable law prohibits limitation;
- statutory consumer rights or remedies that cannot be waived;
- product or service liability that applicable law does not permit us to exclude; or
- any other liability that cannot legally be excluded or limited.
For New Jersey consumers, this section does not waive clearly established rights or remedies under New Jersey or federal law.
31. Indemnification
These Terms do not impose a broad consumer indemnification obligation.
32. Governing Law
To the extent permitted by applicable law, these Terms and disputes concerning them are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. This choice of law does not deprive a consumer of mandatory protections that apply under the law of the consumer's state of residence or another law that cannot validly be waived by contract.
33. Dispute Resolution
These Terms do not include a mandatory arbitration agreement or class-action waiver.
Subject to applicable law, a dispute may be brought in a court of competent jurisdiction. Nothing in this section limits nonwaivable consumer rights or access to a forum that applicable law requires.
34. Consumer Rights and Honest Reviews
Nothing in these Terms is intended to waive, restrict, or disclaim a right granted under consumer-protection, privacy, product-safety, warranty, disability, civil-rights, or other law when that right cannot legally be waived.
Nothing in these Terms restricts a user's right to make an honest review, consumer complaint, government report, or other communication protected by the Consumer Review Fairness Act or other applicable law.
Where a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement controls to the extent required.
For New Jersey consumers, Sections 29 and 30 do not waive clearly established consumer rights or Bellworth Logistics, LLC responsibilities under New Jersey or federal law.
35. Changes to These Terms
We may update these Terms when the Service, business, technology, legal requirements, or product features change.
When the Terms change, the Last Updated date and Terms version must be updated.
We do not rely solely on continued use of the Service as acceptance of materially changed Terms.
For a material change, or whenever otherwise required by law, the Service may require affirmative acceptance of the updated Terms before account-connected functionality continues.
A material change will not retroactively eliminate an accrued consumer right or claim unless applicable law permits that result and the user has validly agreed to it.
During a required legal-reacceptance lock, the main application may remain unavailable until acceptance, while the restricted Account & Privacy surface described in Section 23 remains available.
36. Severability
If a court or other authority with jurisdiction determines that a provision of these Terms is invalid or unenforceable, that provision will be limited or disregarded only to the extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.
This section does not authorize enforcement of any provision that violates a nonwaivable consumer right.
37. No Waiver
If Bellworth Logistics, LLC does not immediately enforce a provision of these Terms, that does not by itself waive the provision or any other lawful right.
A waiver is effective only to the extent permitted by law and only for the particular matter to which the waiver applies.
38. Entire Agreement and Relationship to Other Legal Documents
These Terms govern contractual use of the Service.
The Privacy Policy describes My Personal Pantry's information-handling practices and privacy rights.
The Food Safety Disclaimer provides additional food, allergen, recipe, product-information, and safety limitations and warnings.
The three documents are maintained separately, are versioned separately, and must remain consistent with the released product and with one another.
Additional feature-specific terms may apply if a future feature requires them, but those terms must be disclosed before the user becomes bound by them.
